The access to the WiFi Soy Club service requires the prior and unconditional acceptance of the General Terms of Use presented below ("GTU").
ARTICLE 1. TERMINOLOGY
Definitions
WI-FI terminal(s) :
Refers to the Wi-FI connection terminals installed in the Soy Club Concept Store's member establishments and customers.
User:
Refers to any visitor to an establishment equipped with the Soy Club Concept Store using the Services and owning a Wi-Fi Terminal.
Institution(s):
It is a public or private place such as a bar, shopkeeper, restaurant, hotel, museum, public establishment, which are members and customers of the Soy Club service for which they pay a fee or a service.
Service(s):
Soy Club WiFi Service allowing Users to access the Internet through the network of Wi-Fi Terminals installed in the Establishments.
Login or Login IDs:
Refers to the confidential and personal access codes (login and password) allowing users to authenticate themselves and connect to the service via their personal account.
Facebook Login
The access mode to the Soy Club WiFi service uses the Facebook Login solution in order to authenticate the user and deliver, if the authentication is correct, the Service.
Wi-Fi terminal:
A name for all of a User's computing devices with Wi-Fi connectivity enabled by the User and resulting from an IEEE 802.11 compliant Wireless LAN network card, such as laptops, PDAs (personal digital assistants) personal), cell phones called "Smartphone" (iPhone, Android or Blackberry type cell phone), touch tablets, etc.
VPN
Virtual Private Network.
ARTICLE 2. PURPOSE
The purpose of the TOU is to define the conditions of use of the Service made available to Users in the member establishments and customers of the Soy Club Concept Store. The Service is accessible from any Wi-Fi Terminal. It includes the basic functions of Internet access.
The Service does not include the provision of mailboxes or web page hosting. The proper functioning of the connection of a Wi-Fi Terminal in Wi-Fi mode requires versions of operating systems compatible with the Service. Soy Club recommends the following configuration for the Users' laptops: Computer running Windows (XP, 7, Vista, 2000 or higher) or Mac OS X, pre-equipped with Wi-Fi or equipped with a PCMCIA card that complies with IEE 802.11a/b/g/n standards and is certified by the Wi-Fi Alliance (information available at www.wi-fi.org), with an Internet Explorer browser from version 7, Mozilla Firefox, Google, Chrome or Safari.
ARTICLE 3. ACCESS TO THE SERVICE
The Service is available during business hours at the locations where the Service is available in either of the following ways:
The User decides to benefit from the Service for 30 minutes (renewable) with a broadband connection, provided that he/she has identified himself/herself through his/her Facebook account with the "Facebook Login" button or via email + password and this from the Splashpage pushed automatically after connection to the Wi-Fi network or accessible by entering the following URL in his browser "wifi.soyclub.com or soyclub.shop" and thus have a valid account to use the Service.
ARTICLE 4. ASSISTANCE
Soy Club provides Users with email support to deal with any problems encountered by Users and to ensure that they are handled. This assistance is available by email from 9am to 6pm, except Sundays and holidays, at the following address: support@soyclub.com
ARTICLE 5. COOKIES
It may happen that certain files, called "cookies" and/or unique identifiers (hereinafter referred to together as "Cookies"), are stored by third parties on the User's Wi-Fi Terminal when the User uses the Service. These files make it possible to recognize the User when he visits a website and when he uses the Service, and thus facilitate navigation for the User. In particular, cookies store the User's data so that the User does not have to re-enter them on subsequent visits.
When you use the Services, three main categories of Cookies may be placed on your Wi-Fi Terminal. These types of Cookies are as follows:
- Cookies necessary for the functioning of our Services and Cookies inherent to
- audience measurement cookies and cookies for analyzing the use of our Services,
- Cookies allowing Soy Club or its service providers and partners to determine, display, count and bill the advertisements that may be inserted in the Service access portal, when the User visits it.
The User has the option to neutralize them by configuring his Internet browser accordingly or to delete them from his hard disk. However, the User's attention is drawn to the fact that some of the services offered will then not be accessible or will be only partially accessible if he refuses to accept cookies.
Management of preferences (acceptance/refusal) with regard to Cookies.
If you refuse to accept the installation of Cookies in your Wi-Fi Terminal, or if you delete those already installed, you will no longer be able to use certain features of our Services. This may, for example, affect the content or services you access when you are logged in.
In addition, with our service providers, we will not be able to identify the type of browser your Terminal is using, for technical compatibility purposes. The same applies to language and display settings. We cannot be held responsible for the consequences of a less efficient functioning of our Services due to the impossibility for us to install or read
Cookies necessary for their proper functioning, once you have rejected or deleted them.

ARTICLE 6. COMMITMENTS AND RESPONSIBILITIES OF
THE USER
The User's Identifiers are personal and confidential. The User undertakes to keep his Identifiers, to take all necessary measures to keep them confidential, and not to disclose them in any form whatsoever.
By using these Identifiers, the User has a personalized and exclusive access to the Service. He is therefore prohibited from transferring them to third parties.
Any access to the Service resulting from the use of the User's Identifiers is done under the full responsibility of the latter, Soy Club disclaiming any liability in this regard.
The User is solely responsible for the use of his Identifiers. Any use of the Service made using the User's Identifiers is deemed to have been made by the User, unless proven otherwise.
With regard to the use of the Internet, the User is informed that the Internet is a network carrying data that may be protected by intellectual, literary or artistic property rights or that may infringe the legal provisions in force. The User is therefore prohibited from transmitting on the Internet any data that is prohibited, illicit, illegal, contrary to morality or public order and that infringes or is likely to infringe the rights of third parties and in particular intellectual, literary or artistic property rights.
The User is prohibited from any fraudulent, abusive or excessive use of the Service, such as sending undesirable messages, including abusive, defamatory, obscene, indecent, illegal or infringing on any right, including human rights and the protection of minors, and more generally any act of spamming.
With regard to products or services on the Internet, the User shall address any complaint relating to the performance of the services rendered by them or the sale of the products by them directly to the content providers.
The User is solely responsible for any direct or indirect, material or immaterial damage caused to third parties as a result of his own use of the Service.
Pursuant to Article L331-27 of the French Intellectual Property Code, the User is informed of the provisions of Article L.336-3 of the Intellectual Property Code: The person holding access to online public communication services has the obligation to ensure that this access is not used for reproduction or representation, of making available or communicating to the public works or objects protected by a copyright or by a related right without the authorization of the holders of the rights provided for in books I and II when it is required.
The failure of the person holding access to the obligation defined in the first paragraph shall not result in criminal liability for the person concerned.
In addition, the User is informed that any violation of copyright and related rights within the meaning of the provisions of the Intellectual Property Code may be punishable by the criminal penalties provided for in Chapter V, Title II of Book III of the Intellectual Property Code, without prejudice to civil penalties that may be imposed in order to repair, where appropriate, the damage suffered by the rightful owners.
ARTICLE 7. COMMITMENTS AND RESPONSIBILITIES OF SOY CLUB
Soy Club makes every effort to ensure access to the subscribed Service but is not responsible for the contents accessible through the Internet network and for the damages that may arise from their use unless these damages have been caused intentionally by Soy Club.
Taking into account the secrecy of private correspondence, and the legal provisions applicable in this matter, Soy Club has no control over the content or characteristics of data received or transmitted by the User on its network and/or on the Internet network via its Wi-Fi Terminal. However, in order to ensure the proper management of the Internet access system, Soy Club reserves the right to delete any message or to prevent any operation by the User that may disrupt the proper functioning of its network or of the Internet network or that may not respecting the applicable legal and contractual operating rules.
Exceptions to this rule of confidentiality may be made within the limits authorized by law, at the request of public and/or judicial authorities.
Soy Club cannot be held responsible for the use of data and information that the User would have introduced on the Internet network.
Soy Club declines all responsibility for the consequences of fraudulent, abusive or excessive use of the Service by the User, such as sending unwanted messages, spamming, and other cases of use that could disrupt the availability of the Service or the network.
The responsibility of Soy Club cannot be engaged, in the following legitimate cases:
- If you use equipment that is not compatible with the Services,
- In the event of poor installation and/or poor configuration and/or malfunction of the User's Wi-Fi Terminal and/or the Wireless LAN network card (IEEE 802.11b) of his Wi-Fi Terminal,
- In the event of incompatibility or malfunction of a Wireless LAN network card (IEEE 802.11b) and the Wi-Fi Hotspot network, in particular if the problem is related to a setting on the User's Wi-Fi Terminal making the Wi-Fi Terminal incompatible with the Service,
- In case of incompatibility or malfunction with messaging systems or applications implemented and/or operated by third parties. The possibility of sending e-mails using an e-mail software via the Service depends on the e-mail provider chosen by the User, some providers not allowing the sending of e-mails from another network than their own. It is up to the User to refer to the information on the configuration of his email software with his Internet service provider, Soy Club declining any responsibility in this regard,
- In case of misuse of the Service by the User,
- In case of non-compliance by the User with its obligations,
- In case of impossibility of access via Internet to the VPN of a company,
- In case of use of the Service following a disclosure, loss or theft of the Identifiers associated with the User's account, and more generally, use of the said Service by an unauthorized person, not resulting from a fault of the company Soy Club,
- In case of disruptions or interruptions beyond the control of Soy Club,
- In case of disruptions and / or total or partial unavailability, and / or interruption of all or part of the services offered on the networks operated by operators third to Soy Club,
- In case of force majeure. Soy Club also remains a stranger to all disputes that may arise between the User and third parties.
ARTICLE 8. PERSONAL DATA
8.1. Connection data
In order to improve the experience of Users in establishments equipped with the Services, the Wi-Fi Kiosks allow Soy Club to count the Wi-Fi Terminals and to compile statistics on their visit routes based on their connectivity distance to the Wi-Fi Kiosks.
Fi. These systems depend on the activation of the Wi-Fi antenna of a Wi-Fi Terminal.
When a Wi-Fi Terminal is within range of a Wi-Fi Kiosk, these two pieces of equipment detect each other's presence in order to enable a possible Wi-Fi connection. Where applicable, the Wi-Fi Terminal detects and collects the Media Access Control address, known as the "MAC address", which constitutes a
technical identifier of the Wi-Fi network card of the Wi-Fi Terminal.
Only the activation of the Wi-Fi antenna of a Wi-Fi Terminal allows the collection of its MAC address.
Consequently, only Wi-Fi Terminals whose Wi-Fi connectivity has been activated by their owner are likely to be taken into account and it is sufficient for the owner or the User to deactivate the Wi-Fi antenna of his or her Wi-Fi Terminal so that its MAC address is no longer collected by a Wi-Fi Terminal. In addition, as part of the use of the Services, certain connection data (date of start and end of session, type of Wi-Fi Terminal, type of browser, etc.) collected are processed for the purpose of providing the Service.
All of this data may be used by the Establishments equipped with the Soy Club Service for statistical, marketing and commercial purposes and in particular in order to provide Users with services and offers adapted to their visit to the Establishments. Aggregate statistics or unit processing of these data, are based on the processing and storage of traffic data for a period not exceeding 13 months.
In addition, in accordance with the legal and regulatory provisions in force, Soy Club is obliged to collect and store electronic communication data relating to traffic for a period of 13 months in accordance with the provisions of the Code of Post and Electronic Communications. To this end, Soy Club may be required to communicate
these data to the public authorities upon judicial requisition for the purposes of research, ascertainment and prosecution of criminal offences, for the prevention of any activity of a terrorist nature.
These data may also be used by Soy Club in the form of aggregate statistics for information purposes on the operation and use of the Services.
8.2. Account data
When using the Services, the User may create an account in which he/she can provide certain data such as his/her name, surname, first name, age, e-mail address, country of residence, etc.
These data are necessary for the provision of the Service and may be processed by Soy Club and the Establishments for statistical or commercial purposes.
They may also be used by Soy Club for statistical studies. Unless the User objects or subject to his consent, as the case may be, his personal data may be used for marketing purposes. The data thus
collected will be used by Soy Club and the Establishments for their usual marketing activities.
Soy Club and the Establishments may carry out marketing communication campaigns by electronic means (email, SMS, display of advertising content when the user is browsing on the Internet or via a mobile application) to Users who have given their consent.
